I the undersigned, must be 18 years of age to sign and acknowledge, appreciate, and agree that 1. I understand, AS PER GILMER COUNTY, GA ORDINANCE-NO ALCOHOL IS PERMITED AT ANY TIME ON THE CARTECAY RIVER 2. The risk of injury from the activities involved in this program are significant, including the potential for permanent paralysis and death 3. I KNOWINGLY AND FREELY ASSUME ALL SUCH RISKS, both known and unknown, EVEN IF ARISING FROM THE NEGLIGENCE OF THE RELEASE ES or others and assume full responsibility for my participation. 4. I willingly agree to comply with terms and conditions for participation. If I observe any significant hazard during my presence or participation, I will remove myself from participation and bring such to the attention of the nearest official immediately. 5. By participating in or attending any activity in connection with this program of Cartecay River Experience, LLC whether on or off the premises, I consent to the use of any photographs, film, or videotape taken of me or provided by me for publicity, promotion, television, websites or any other use, and waive any right of privacy, compensation, copyright or other ownership right to same. 6. I, for myself and on behalf of my heirs, assigns, personal representatives and next of kin, HEREBY RELEASE, INDEMNIFY, AND HOLD HARMLESS CARTECAY RIVER EXPERIENCE, LLC its officers, officials, agents, volunteers, and/or employees, other participants, sponsors, advertisers, the United States, AWA, The State of Georgia and if applicable, owners and lessors or premises used to conduct the event (RELEASE ES), from any and all claims, demands, losses, and liability arising out of or related to any INJURY, DISABILITY OR DEATH that I may suffer, or loss or damage to person or property, WHETHER ARISING FROM THE NEGLIGENCE OF THE RELEASEES OR OTHERWISE, to the fullest extent permitted by law. 7. I knowingly agree freely to not enter private residences along the Cartecay River including the use of rope swings and understand THIS IS TRESPASSING and will assume full responsibility. 8. ANYONE under the age of 18 years of age MUST have a parent or guardian sign *I am 18 years of age or older and HAVE READ THIS RELEASE OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT FULLY AND UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND SIGN IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT.
